Hi
need some advice on a contract dispute with a seller in Austria, I am from England and the lady has refused to refund my €1300 deposit for 2 kittens. Ihre Vertrag übernimmt nicht den Verbrauchergesetze in Österreich und braucht wirklich Hilfe. She will not refund me or respond to any emails,

Regards Gary jones

I expect, it was a private seller. If you assume fraud, you can send a report to the Austrian police:

https://www.polizei.gv.at/alle/kontakt.aspx/

Otherwise my first thought was this (Europäische Verfahren für geringfügige Forderungen oder Europäisches Bagatellverfahren or European Small Claims Procedure):

https://www.oesterreich.gv.at/themen/gesetze_und_recht/gerichtsorganisation_der_justiz/zivilrecht/2/1/Seite.1010327.html
(check also the links, where you can change the language in English)

or

https://europa.eu/youreurope/citizens/consumers/consumers-dispute-resolution/formal-legal-actions/index_en.htm

I am absolutely not sure, if it still works for citizens in Great Britain, because in "Form A - Claim form" they write:
As of 1 January 2021, the United Kingdom is no longer an EU Member State. However, in the field of civil justice, pending procedures and proceedings initiated before the end of the transition period will continue under EU law. Until the end of 2024, the United Kingdom can continue to be selected in online (dynamic) forms for the purpose of these proceedings and procedures. An exception to this rule are the Public documents forms, in which the UK should not be selected.
